Terms of Use

1. Who you are agreeing with

Apex Gallery is operated by Teal Apex Solutions LLC, a Georgia limited liability company (“we”, “us”). By taking a key and entering the gallery, you agree to these terms. If you do not agree to them, do not enter.

2. Your key

Access is personal to you. Do not share your credentials, and do not create an account with somebody else’s name or email. You are responsible for what happens under your key. We may withdraw access from any account, at any time, for any reason, and we will do so immediately in the case of scraping, resale, or abuse.

3. The work is demonstration work

Every site in this room is a real, working build, and it is also a demonstration. The businesses in them are fictional. The prices, addresses, phone numbers, reviews, testimonials, availability and figures are invented for the purpose of showing design and engineering capability. Nothing in a showcase site is an offer, and no relationship with any real business of a similar name is implied. Do not attempt to place a genuine order, book a genuine appointment, or send genuine payment details into a showcase build. No order will be fulfilled, because there is nobody on the other end of it.

4. What you may do

• View, use, and thoroughly test every site in the room, on any device you own.
• Show the gallery to a colleague, a partner, or the person who signs the cheque, in order to evaluate whether to hire us.
• Ask any question you like about any of it, including the hard commercial ones.

5. What you may not do

• Copy the code. The HTML, CSS, JavaScript, layouts, components, motion engines, and copy in these builds are ours. Viewing source in a browser is how the web works; lifting it into your own product is not.
• Scrape the room. No bots, crawlers, harvesters, or automated collection of the gallery or the sites in it.
• Resell or relicense the work, in whole or in part, or present it as your own or your agency’s portfolio.
• Use it to train a model or to build a derivative catalog of templates.
• Attack it. No penetration testing, load testing, credential stuffing, or attempts to reach data that is not yours, without our written permission. Ask first and we will very likely say yes.

6. Ownership

All intellectual property in the gallery and in the works shown in it remains with Teal Apex Solutions LLC unless and until it is transferred to you under a separate, signed agreement. Entering the room grants you a personal, revocable, non-transferable licence to look. It grants you nothing else.

When you buy a build, you own it. That is the deal, and it is written into the engagement, not into this page. The code for the site we deliver to you becomes yours, outright, with no page-builder rent and no platform that can switch your storefront off. Shared engines, component libraries, and the underlying tooling remain ours and are licensed to you perpetually for use in that build.

7. Photography and third-party assets

Photography in the showcase builds is licensed stock, credited within each build. Fonts and open-source libraries carry their own licences. Those licences do not transfer to you merely because you looked at a page that used them.

8. No warranty on the demonstrations

The gallery and the showcase builds are provided as is. They are demonstrations, not products you have bought, and they carry no warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted availability. A site we build for you carries the warranty written into that engagement, which is a different document and a real one.

9. Limitation of liability

To the fullest extent the law allows, Teal Apex Solutions LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of this gallery. Our total liability arising out of the gallery is limited to one hundred United States dollars. Nothing here limits liability for fraud, or for anything else that cannot be limited by law.

10. Governing law

These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. The courts of Columbia County, Georgia have exclusive jurisdiction, and you and we both consent to that venue.

11. Changes

We may update these terms. The date at the top will change when we do. If you keep using the gallery afterwards, you are agreeing to the updated version.
